From sketch to granted patent, the fees arrive in stages over more than a decade.

The most common budgeting mistake inventors make is pricing the filing and forgetting the decade that follows it. A U.S. utility patent is paid for in installments, and the last one arrives eleven and a half years after the patent issues. Up front, a typical mechanical invention handled by a patent attorney runs about $15,000 to $25,000 before it is granted, a planning range the patent law site BitLaw gives, while the USPTO’s own filing and issue fees for a small business come to just $1,246 of that. Keeping the patent alive to full term adds another $5,788 in small-entity maintenance fees.

So the useful question is not one number but when each bill lands, and which ones you can shrink. Below is the money in the order you will spend it, using the USPTO fee schedule that took effect January 19, 2025 and was last revised November 1, 2026, the version that applies as you plan for 2027.

The quick answer for 2027: USPTO fees alone for a utility patent through grant are $3,290 for a large company, $1,246 for a small entity and $658 for a micro entity (electronic filing, no extra claims). With an attorney searching, drafting and answering the examiner, BitLaw’s planning range is $15,000 to $25,000 before grant. A design patent is far cheaper: about $1,500 to $3,000 all in.

Before day one: the $1,000 search that can save $15,000

Nothing in patent law requires a search before you file, and the USPTO charges nothing for one you do yourself. The office’s Patent Public Search tool and Google Patents are both free. A professional patentability search, with an attorney’s opinion on what it found, typically costs $1,000 to $3,000 according to UpCounsel and Rapacke Law Group, and up to $4,000 at some firms.

That is the cheapest insurance in the whole process. If the search turns up a near-identical earlier patent, you have spent a few thousand dollars instead of the five figures it takes to draft an application and fight for it. Some firms will credit some or all of the search fee toward drafting if you go ahead, so ask before you pay it.

Month 0: a provisional buys a year for $65 to $325

A provisional application is a placeholder. It is never examined, it lets you mark the product “patent pending,” and it locks in your filing date for 12 months while you test the market or raise money. The government fee is small: $325 for a large entity, $130 for a small entity and $65 for a micro entity.

The writing is where prices split. Rapacke Law Group lists $2,000 to $6,000 for an attorney-drafted provisional. Inventors can file their own for the government fee alone, and plenty do. The catch is that a provisional only protects what it actually describes. A two-page sketch filed for $65 can leave you with a priority date that covers nothing you later claim, which is why BitLaw warns that a provisional does not necessarily lower the total bill. It moves part of it earlier.

Month 12: the nonprovisional, where most of the money goes

Within a year of the provisional, or on day one if you skip it, you file the full utility application. This is the document the examiner reads and the one a court would read years later, so it is where good attorneys earn their fees. Three USPTO fees are due together:

USPTO fee at filingLarge entitySmall entityMicro entity
Basic filing fee$350$70 (electronic) or $140$70
Search fee$770$308$154
Examination fee$880$352$176
Total at filing$2,000$730$400
Each independent claim over 3$600$240$120
Each claim over 20$200$80$40
Filing on paper (surcharge)$400$200$200
Not filed as DOCX (surcharge)$430$172$86
Source: USPTO fee schedule, effective January 19, 2025, last revised November 1, 2026.

Those last two rows are pure self-inflicted cost. Filing electronically in DOCX format avoids both, and a small entity that files on paper pays at least $442 more than one that files a DOCX electronically. Claim count matters more: a fourth and fifth independent claim add $1,200 for a large company before anyone has examined a word.

Attorney drafting fees dwarf all of this. BitLaw, drawing on the American Intellectual Property Law Association’s economic survey, puts most applications at $9,000 to $17,000: about $9,000 to $11,000 for a simple mechanical device, $13,000 to $16,000 for medical devices and software, and $17,000 or more for complex technology. Rapacke Law Group quotes a wider $5,000 to $15,000 for drafting alone. Formal drawings are often extra, so ask whether a quote includes them.

On 2027 specifically: we found no new patent fee rule announced for next year, and the fee schedule’s only change on November 1, 2026 touched an international search fee. The bigger idea floated in 2025, a yearly charge of 1% to 5% of a patent’s value, appears to be off the table. Commerce Secretary Howard Lutnick told a Senate subcommittee on February 10, 2026 that it “is not a plan,” as IPWatchdog reported.

Months 12 to 40: the wait, then the argument

Then nothing happens for a long time, which is free. The average wait for a first decision from an examiner was 22.6 months in fiscal 2025, up from 19.9 months the year before, according to USPTO dashboard figures cited by the law firm Wolf Greenfield. Most utility patents take 24 to 36 months from filing to grant.

That first letter is usually a rejection, and answering it is the second-biggest line in the budget. BitLaw puts each response at $3,500 to $4,500 and says one to three rounds are typical before allowance; Rapacke’s range is lower, $1,000 to $3,000 per response. Where the money leaks:

  1. Missing the three-month deadline. Extensions cost a small entity $94 for one month, $276 for two and $636 for three. Large entities pay $235, $690 and $1,590.
  2. Restarting after a final rejection. A request for continued examination costs $600 for a small entity the first time and $1,144 for each one after that, plus the attorney’s time to write the new response.
  3. Burying the examiner in references. An information disclosure statement citing more than 50 items now carries a $200 fee, rising to $500 past 100 and $800 past 200, at every entity size.
  4. Paying to jump the line without needing to. Prioritized examination (Track One) costs $1,806 for a small entity and $4,515 for a large one. It is worth it when a licensing deal or investor is waiting on a granted patent, and rarely otherwise.

Allowance: a three-month window to pay $258 to $1,290

When the examiner agrees, you receive a Notice of Allowance and have three months to pay the issue fee: $1,290 for a large entity, $516 for a small entity and $258 for a micro entity. Many firms bill a few hundred dollars to process it. The patent usually issues a few weeks after payment, and from that date the maintenance clock starts.

Years 3.5, 7.5 and 11.5: the fees that test whether the patent earns its keep

Utility patents do not stay in force on their own. Three maintenance fees are due, counted from the grant date, and each one is larger than the last. Design patents have none.

Due after grantLarge entitySmall entityMicro entity
3.5 years$2,150$860$430
7.5 years$4,040$1,616$808
11.5 years$8,280$3,312$1,656
All three$14,470$5,788$2,894
Source: USPTO fee schedule. Fees can be paid during the six months before each due date.

Each payment is a decision point, and treating it as one saves money. A patent on a product you stopped selling, in a market no competitor is entering, may not be worth $3,312 at year 11.5. Letting it lapse is a legitimate choice; many companies prune their portfolios exactly this way.

Put the whole timeline together and the totals look like this. The example below is hypothetical: a mechanical invention, an attorney-drafted provisional at $3,000, a $2,000 search, $10,000 to draft the full application, two office action responses at $3,000 each, electronic filing and no extra claims.

Stage (example)Small entity, running totalLarge entity, running total
Provisional filed (month 0)$3,130$3,325
Search and nonprovisional filed (month 12)$15,860$17,325
Two office actions answered (about months 35 to 40)$21,860$23,325
Issue fee paid, patent granted$22,376$24,615
All three maintenance fees paid (about year 15)$28,164$39,085

Note where the gap between the two columns opens up. Through grant, small-entity status saves about $2,200. Over the full term it saves nearly $11,000, almost all of it in maintenance fees.

Which fee column do you belong in?

Claiming the wrong status is a mistake in both directions: overpaying for years, or underpaying and putting the patent’s enforceability at risk. The rules in brief, which a registered practitioner should confirm for your situation:

Small entity (60% off most fees)

Generally available to independent inventors, nonprofits, universities and businesses with fewer than 500 employees, counting affiliates, provided you have not assigned or licensed the invention to a larger company. Most startups and family businesses qualify.

Micro entity (80% off most fees)

You must qualify as a small entity, have been named on no more than four earlier nonprovisional applications, and earn no more than the USPTO’s income cap. As of September 15, 2026 that cap is $262,380 in gross income for the prior year, and it resets every fall based on Census data. University employees can qualify through a separate route.

Large entity (full fees)

Everyone else, including a small inventor who has licensed the invention to a big manufacturer. Status is checked at each payment, so a patent can move from the small to the large column after a licensing deal, and the next maintenance fee must be paid at the higher rate.

The design patent: one payment, no decade of fees

If what makes your product valuable is how it looks rather than how it works, a design patent protects the ornamental shape for 15 years from grant at a fraction of the price. USPTO fees total $2,600 for a large entity ($300 filing, $300 search, $700 examination and a $1,300 issue fee) and $1,040 for a small entity. There are no maintenance fees at all. With attorney work and the formal drawings these applications depend on, BitLaw estimates about $2,000 in total, and Rapacke puts typical totals at $1,500 to $3,000.

The trade-off is narrow protection: a competitor who changes the look while copying the function is usually outside it. Some products deserve both kinds of patent; most inventors should ask an attorney which one actually covers what a copycat would take.

What inventors ask after the first quote arrives

Can I file a patent myself without a lawyer?

Yes. Inventors may file and prosecute their own applications, paying only USPTO fees, and the USPTO runs a Pro Se Assistance Center to help with procedure. Its staff cannot draft claims or give legal advice, though, and weak claims are the most common reason a self-filed patent ends up protecting little.

How much does it cost to file a patent if I only want patent pending status?

As little as $65 to $325 in USPTO fees for a provisional application, depending on entity size. That status lasts 12 months, and it lapses unless you file a full nonprovisional application before then.

What happens if I miss a maintenance fee?

There is a six-month grace period with a surcharge, currently $216 for a small entity and $540 for a large one. After that the patent expires, and reviving it requires a petition, which costs a small entity $904 if the delay is under a year.

How long does a patent last once I pay for it?

A utility patent generally lasts 20 years from the date the nonprovisional application was filed, as long as maintenance fees are paid. A design patent lasts 15 years from grant with no maintenance fees.

How much is a patent search if I do it myself?

Free. The USPTO’s Patent Public Search tool and Google Patents cost nothing to use. A professional search with an attorney’s analysis usually runs $1,000 to $3,000, and some firms charge up to $4,000.

Three calls to make before spending a dollar

1. Your regional Patent Pro Bono Program. The USPTO’s nationwide network matches volunteer patent attorneys and agents with inventors whose household income is under three times the federal poverty guidelines. You need either a provisional already on file or a completed training course. Write to probono@uspto.gov or find your state’s program on the USPTO site.

2. A law school patent clinic. Schools in the USPTO’s Law School Clinic Certification Program let supervised students draft and file applications, usually without charging for the legal work. Expect a slower pace and limited slots.

3. Two or three registered practitioners for flat-fee quotes. Only attorneys and agents registered with the USPTO may represent you there; check names in the office’s practitioner search. Ask each for a written flat fee covering search, drafting, drawings and the first office action response, so you can compare like with like. Be wary of invention promotion companies that promise marketing and patenting in one expensive package; a registered practitioner’s number tells you who is actually doing the legal work.

Pricing method: prices were researched in November 2026 for 2027 planning and may change. Government fees come from the USPTO fee schedule (effective January 19, 2025, last revised November 1, 2026) and the USPTO’s micro entity and pro bono pages; attorney ranges come from BitLaw, UpCounsel and Rapacke Law Group; pendency figures are USPTO data as reported by Wolf Greenfield. This is general information, not legal advice; confirm fees and entity status with the USPTO or a registered patent practitioner. See our disclaimer.
