How much does a lawyer cost: fee agreement, calculator and clock on an attorney's desk

Hourly, flat fee or contingency: the billing method shapes the final legal bill.

An hour of a bankruptcy lawyer’s time costs more than twice an hour of a criminal defense lawyer’s: $481 against $219, according to Clio’s 2026 rate data. Across all practice areas, US lawyers billed an average of $362 an hour this year. But the hourly rate is only one of four ways you can be charged, and for many problems it is not the cheapest. A routine matter on a flat fee can cost $1,500, while the same lawyer’s clock on a fight can pass $12,000.

So the useful question for 2027 is not just how much a lawyer costs. It is which billing method fits your problem, and how to ask for it. The sections below compare the four options, show where each one wins, and end with a simple rule for choosing.

Four ways a lawyer can bill you, side by side

Billing methodHow you payTypical priceUsually cheapest for
HourlyEvery tenth of an hour, usually drawn from an upfront retainer$362 an hour national average (Clio, 2026); $205 to $506 by stateOpen-ended disputes, business advice, matters you can keep short
Flat feeOne quoted price for a defined taskUncontested divorce with a lawyer: $1,500 to $4,500 (LegalShield)Simple wills, traffic tickets, uncontested divorces
ContingencyA share of what you recover; nothing if you lose33.33% before a lawsuit, often 40% once litigation startsInjury and accident claims
Limited scopeHourly or flat, but only for the parts you chooseLess than full representation, per the Supreme Court of Ohio; no national figurePeople handling their own case who need coaching, a document review or one hearing
Contingency and flat-fee ranges come from TexasLawHelp and LegalShield; hourly figures from Clio’s 2026 rate tables.

Many lawyers will offer more than one of these if asked. A family lawyer who bills hourly for a custody fight may quote a flat fee for an agreed divorce. A business lawyer may do formation work for a set price and contract disputes by the hour. The method on the first proposal is the lawyer’s default, not a rule.

Your legal problem moves the rate more than your ZIP code

Location matters: Clio’s 2026 state averages run from $205 an hour in West Virginia to $506 in Delaware, with New York at $440, California at $430, Texas at $380, Florida at $378 and Ohio at $287. Yet the type of work produces gaps nearly as wide inside the same state. National averages from the same 2026 tables:

Practice areaAverage hourly rate, 2026
Corporate litigation$484
Bankruptcy$481
Trusts$419
Business formation and compliance$400
Wills and estates$391
Family law$357
Traffic offenses$345
Personal injury$324
Insurance$225
Criminal defense$219
Workers’ compensation$187
Juvenile$132
Source: Clio, lawyer rate comparison, updated October 2026.

Two cautions. These are averages of what firms using Clio’s software bill, so a big-city partner can charge well above them. And a high hourly rate is not the same as a high total; an experienced estate lawyer at $450 who drafts a will in three hours beats a slower one at $300 who takes six.

“The average hourly rate for a lawyer in the United States is $362, which has changed 4% year over year.”

Clio, Legal Trends lawyer rate data, 2026

No national fee change is announced for 2027; lawyers set their own rates, and most adjust them in January. If that 4% pace holds, budget a little above today’s quotes for work that will run deep into next year.

Hourly billing: fair for fights, risky for anything open-ended

Hourly work almost always starts with a retainer, an upfront payment the lawyer holds and bills against, as TexasLawHelp explains. It is a deposit, not a price. When it runs low, you are asked to top it up, and the unearned balance should come back to you when the case ends.

Hourly billing makes sense when nobody can predict the work: a contested custody case, a lawsuit, a business dispute. It also explains why fighting costs so much. LegalShield puts a contested divorce settled in mediation at $5,000 to $7,000, rising to $12,000 or more when the couple cannot agree, and its Massachusetts and Virginia lawyer quotes show uncontested cases ending far lower.

Hypothetical example: a parent hires a family lawyer at Clio’s $357 national average. A modification motion that takes 12 hours of drafting, calls and one short hearing comes to about $4,280. If the other side contests it and the work stretches to 40 hours, the bill reaches about $14,280. Same lawyer, same rate; the conflict set the total. You control part of that number: every email, call and late document adds billable minutes.

  • Ask for the billing increment (many firms bill in tenths of an hour) and whether paralegal time is billed at a lower rate. Clio puts the average non-lawyer rate at $194.
  • Ask for monthly itemized invoices and a written estimate, with a ceiling the firm must check with you before passing.
  • Batch your questions into one email instead of five.

Flat fees: the best deal for paperwork with a known ending

TexasLawHelp lists simple wills, traffic tickets and uncontested divorces as typical flat-fee work, and that list is a good test. If the task has a predictable end point and little chance of a fight, a set price moves the risk of extra hours onto the lawyer. LegalShield’s lawyer quotes for an uncontested divorce, $1,500 in Virginia and $3,000 to $4,500 in Massachusetts, show how a flat fee caps what could otherwise climb by the hour.

The trap is the fine print. A flat fee covers the defined task, and court costs usually sit outside it. LegalShield lists divorce filing fees of $50 to $450 and process servers at $20 to $100. Ask three things before signing: what exactly is included, what triggers hourly billing (a contested hearing, say), and whether filing fees are in the quote. Our legal name change cost guide shows how those government fees stack up even on a simple petition.

A third of the settlement: when contingency is worth it

For injury claims, contingency is the norm. TexasLawHelp says a typical fee is 33.33% before a lawsuit is filed and 40% if the case goes into litigation, and the American Bar Association describes fees as often one-third to 40%. You pay nothing upfront and nothing if you lose, which is why it suits people who could never fund a case by the hour.

The step from 33% to 40% is where the money is. Hypothetical example: on a $60,000 settlement, a one-third fee is $20,000; at 40% it is $24,000. Ask when the higher rate kicks in (on filing, or only at trial), and whether case expenses such as records and expert fees come out before or after the lawyer’s percentage. That order alone can shift what you keep by hundreds or thousands of dollars. Our auto accident attorney fees breakdown walks through a full settlement statement.

Contingency is not always the better buy. With a small, clear claim and a cooperative insurer, a few hours of hourly advice can cost far less than a third of the check.

Hiring a lawyer for only the hard parts

Limited scope representation, also called unbundled or a la carte legal services, lets you handle most of a case yourself and pay a lawyer for chosen pieces: reviewing a settlement, drafting one motion, coaching you before a hearing or appearing at just one. The ABA’s Model Rule 1.2(c) allows it when the limits are reasonable and you agree in writing, and the Supreme Court of Ohio notes that it usually costs less than hiring a lawyer for the whole case.

It works best for organized people with modest disputes: small family matters, landlord problems, simple contracts. It works poorly when the other side has a lawyer and the stakes are high. Get the limits in writing, so you both know which parts are yours.

Lower-cost ways to reach a lawyer in the first place

Bar referral services. The New York State Bar Association’s service matches you with a lawyer for a $35 half-hour consultation, waived for personal injury, Social Security and several other case types. The New Haven County Bar charges a $35 processing fee that includes a half-hour consult, and the Alabama State Bar’s 2026–2027 program caps the first 30 minutes at $50. Search your state or county bar for the same thing.

Legal aid. Nonprofit programs funded by the Legal Services Corporation generally serve households with incomes at or below 125% of the federal poverty guidelines, for civil problems such as eviction, benefits and domestic violence. Criminal defendants who face jail and cannot afford a lawyer have a right to appointed counsel.

Prepaid legal plans. These trade a monthly fee for calls, letters and document reviews. NerdWallet lists LegalShield’s small-business plans at $49, $99 and $169 a month, each with 25% off the attorney’s hourly rate for extra work. A plan pays off if you use it several times a year; for one problem, a referral consult is usually cheaper.

Fee questions that come up at the first meeting

How much does it cost for a lawyer to represent you in court?

Court work is usually billed hourly, so the total depends on preparation time as much as the hearing itself. A short hearing may add a few hours at your lawyer’s rate, while a trial can add days. Ask for a separate estimate for preparation and for each day in court before you agree.

Is a lawyer’s retainer refundable?

The unearned part generally is. Under ABA Model Rule 1.16(d), adopted in some form by most states, a lawyer must return any advance fee that has not been earned when the representation ends. Ask for a final accounting of the trust balance.

Can I make the other side pay my legal fees?

Usually not. Under the American rule, each side pays its own lawyer unless a statute or a contract says otherwise. Some consumer, civil rights and lease or contract disputes include fee-shifting terms, so ask your lawyer whether one applies.

Can you negotiate how much a lawyer charges?

Often, yes. You can ask for a flat fee instead of hourly billing, a lower retainer, a cap on hours or a payment plan. TexasLawHelp notes that some lawyers accept installment plans with monthly payments. Get any change in the written fee agreement.

Do lawyers charge for phone calls and emails?

Hourly lawyers usually do, at their normal rate and in small increments. A two-minute email can be billed as six minutes at many firms. Flat-fee and contingency clients usually are not billed separately for routine contact, but confirm this in the agreement.

Match the billing method to the problem

If your problem looks like this

  • A defined task with a known end: a will, a ticket, an agreed divorce
  • You were hurt and someone else’s insurer will pay
  • You can do most of it yourself but fear one step
  • A real dispute with an unpredictable path
  • Low income and a civil problem such as eviction

Ask for this

  • A flat fee, with filing costs listed separately
  • Contingency, at 33% before suit and a clear trigger for anything higher
  • Limited scope, with the limits in writing
  • Hourly, with a written estimate, a cap and monthly invoices
  • Your local legal aid office before any private lawyer

Fees vary widely by lawyer, state and case, and nothing here is legal advice. Use a $35 to $50 bar referral consult to get a real quote, and confirm every term in a signed fee agreement.
